CO129-610-5 Marriages solemnized in Stanley Camp during the Japanese occupation and subsequent legislation for divorce 14-2-1947 - 27-6-1947 — Page 12

CO129 Colonial Office Hong Kong Records 理藩院香港檔案 All

Mr. Galsworthy.

Hong Kong Divorces.

I have seen the Hong Kong immediate

telegram. I do not want to raise any ob-

jection to their draft Ordinance, but they

might like to consider the following

The definition of, I think it is, "Supreme

Court" seems to assume a positive answer to

the very question at issue, i.e. whether

the Chief Justice sitting in the internment

camp was the Supreme Court of the Colony.

It might be preferable, therefore, to

amend the definition to avoid this assumptio

if the definition is required, but as there

is no other reference to the Court in the

telegram the definition may be unnecessary.

In any event I think the parties to

the divorce, when they are informed of this

legislation, should be warned of the doubt

as to its efficacy if the husband was

not domiciled in the Colony at the time.

30th May, 1947.
